Does the SAVE Act become law before 2027?

The SAVE Act, a bill that would require documentary proof of citizenship to register to vote in federal elections, looks all but dead for this Congress, and a Kalshi market on whether it becomes law is pricing that reality. On August 8, 2026, the Senate voted 52–46 on a key procedural motion for the SAVE Act’s companion bill, falling eight votes short of the 60 needed to advance, then went into a five‑week recess. Kalshi’s contract asks whether either the original SAVE Act (H.R.22) or a successor version with a photo‑ID requirement becomes law before January 4, 2027, and “No” now trades at 96 cents. That is the bet we are taking to capture 4.16% in 4 months.

The legislative math has not changed all year. Republicans hold 53 Senate seats, but breaking a filibuster requires 60 votes, and no Democrat has provided the extra support needed to reach that threshold. Which is why the August vote came in at 52.

President Trump has tried to force the issue but unsuccessfully. On July 27, he told the Senate on Truth Social not to “leave town” until it passed the bill or eliminated the filibuster. Majority Leader John Thune replied that a filibuster carve‑out was “not even close” to having the votes and told the White House to find Democratic support instead. A parallel route closed on June 24, when a federal judge permanently blocked the proof‑of‑citizenship provision in Trump’s executive order.

The only remaining path would be attaching the SAVE Act’s requirements to a must‑pass bill the Senate cannot refuse, and House Republicans have tried to hang the language on defense authorization. The long shot is what "Yes" traders are essentially hanging on. The Senate will soon return on September 14 and spend most of October to the midterms, plus it is expected to adjourn before Christmas, leaving a very narrow window for any such maneuver.
